National Cadastre

The National Cadastre is a system of legal, technical and other additional information organized on a property-centric basis for all real estate in the territory.
The process of compiling the cadastral register is carried out in two phases:
During the first phase, which includes the cadastral registration process, data is collected on the real rights over the properties included in the areas under cadastral registration, which is done with reference to the pre-Kapodistrian Local Authorities to which the CADASTERY CODES per Local Authority are assigned. During the second phase, which follows the first, the results of the cadastral survey are collected and transferred to the cadastral database of the cadastral offices and now all registrations are made on this database. This database is land-centered, meaning that the search is not made with the name of the owner – as is done to date in the mortgage registries – but with the property which has its own code number called the National Cadastral Code Number or KAEK . The information recorded for each specific property is contained in the Cadastral Sheet of the property, the content of which was determined by the decision number 168/3a/17-7-2003 of the board of directors of the OKXE which was published in the Official Gazette B' 1042/28-7-2003
If you want to see if the area in which your property is located has been transferred to an operating cadastral office, search for it in the table of cadastral offices. The operation of cadastral offices is governed by the basic LAW 2664/1998 – which has undergone many amendments – and which provides for the consequences of transferring cadastral data to the cadastral books of each cadastral office. The consequences of this transfer are basically threefold:
The first is that no transaction can be carried out on registered properties if they do not agree with the data in the cadastral database that has been transferred to the cadastral offices.
The second is that if these registrations are inaccurate and are not corrected within a specific deadline, which is 31-12-2026 for cadastral registrations before the year 2006 and 31 December of the 8th year for cadastral registrations made after 2006 from the start of operation of the cadastral office, then they produce an irrefutable presumption in favor of the listed beneficiary of the right listed on the cadastral sheet of the property. This is particularly important because it can lead to the loss of the relevant right if the correction of the inaccurate cadastral registration is not made within the deadline.
The third is that for all properties for which a declaration was not submitted during the cadastral registration stage, an unknown owner was listed on the cadastral sheet.
The exclusive deadline for correcting these entries expires for all old – pre- 2006 – cadastral registrations on 31-12-2026 and for those declared after 2006 it expires on 31 December of the 8th year from the start of operation of the cadastral office, e.g. for the area of the Municipality of Athens with start of operation on 20-03- 2023 the deadline expires on 31-12-2030. This means that if the above period provided for the correction of these entries, as the case may be, passes without action, the property becomes the property of the person listed on the cadastral sheet as the beneficiary and if no person is listed as the beneficiary then it becomes the property of the Greek State. It is therefore important that all owners know how their property has been registered in the land registry so that they can take the necessary steps in a timely manner to correct any errors that may have been made during the cadastral registration.
